Terms of Service

Drape is an AI-powered fashion video studio that enables brands and creators to transform clothing photographs into professional commercial videos. The Service uses generative AI and machine learning — including virtual try-on and cinematic video synthesis — to produce fashion content for marketing, social media, and e-commerce.

The Service includes a credit-based generation system, video editing tools, custom AI model training, and integrations with third-party platforms such as Shopify. Features, availability, and pricing are subject to change at our reasonable discretion. We will give advance notice of material changes where practicable.

To access the Service you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

You must be at least 16 years old to use the Service. By creating an account you represent that you meet this age requirement. If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

Notify us immediately at hello@drapenow.com of any unauthorized access to your account. We are not liable for losses caused by unauthorized use of your credentials.

Drape offers subscription plans ("Plans") that grant access to generation credits and features. Subscriptions are billed on a recurring monthly basis at the rates published on our Pricing page. All prices are in USD unless otherwise stated.

Payments are processed by Stripe, Inc. By providing payment information you authorize us to charge your payment method on a recurring basis. We do not store raw card details — all payment data is handled by Stripe in accordance with PCI-DSS standards.

Refunds. Due to the computational cost of AI video generation, subscription fees and credit purchases are generally non-refundable. Exceptions may be made at our discretion for verified technical failures attributable to Drape. Contact us within 7 days of the charge in question at hello@drapenow.com.

Plan changes. You may upgrade or downgrade your plan at any time. Upgrades take effect immediately; downgrades take effect at the next billing cycle. Cancellation stops future charges but does not entitle you to a refund for the current billing period.

The Service operates on a credit system. Each generation action consumes credits according to the generation type (with or without virtual try-on), video duration, and model quality selected. Current credit costs are displayed in the interface before generation begins.

Credits are non-transferable, have no cash value, and cannot be sold, gifted, or exchanged. Unused subscription credits expire at the end of each billing period unless your plan description states otherwise. One-time purchased credits may carry different expiration terms as disclosed at the time of purchase.

We reserve the right to adjust credit costs for generation types with reasonable advance notice. We are not responsible for generation failures caused by invalid inputs (e.g., unsupported image formats, inappropriate content). In cases of a verified system-side generation failure, we will restore consumed credits at our discretion.

Your content. You retain all ownership rights to the original content you upload to Drape, including garment images and any other materials ("User Content"). By uploading User Content, you grant Drape a non-exclusive, worldwide, royalty-free license to process, store, and use your User Content solely for the purpose of providing and improving the Service.

Generated videos. Subject to your compliance with these Terms and full payment of applicable fees, Drape assigns to you all rights in the AI-generated videos produced from your User Content. You may use these videos for commercial purposes, including advertising, social media, and e-commerce, without restriction.

Drape's IP. Drape retains all ownership rights to the Service, including all software, AI models, algorithms, interfaces, documentation, and branding. Nothing in these Terms transfers any Drape intellectual property to you.

Third-party content. You must hold all necessary rights to any content you upload. Drape is not responsible for third-party intellectual property claims arising from your User Content.

Drape uses generative AI to produce videos. You acknowledge that AI outputs may be imperfect, inconsistent, or unexpected, and that exact outputs cannot be guaranteed. Drape makes no warranty that generated videos will be fit for any specific commercial purpose.

Content responsibility. You are solely responsible for ensuring that AI-generated videos you distribute comply with all applicable laws, advertising standards, platform policies, and third-party rights. Drape does not review generated content for legal compliance on your behalf.

Model training. By default, we do not use your User Content or generated videos to train our AI models. You may opt in to a data contribution program through your account settings, which may be accompanied by additional credits or benefits. Opt-in consent can be withdrawn at any time.

Likeness and representation. If you use virtual try-on features with imagery depicting real individuals, you represent that you have obtained all necessary rights and consents from those individuals prior to upload.

You agree not to use the Service to:

• Generate content that is illegal, defamatory, obscene, hateful, or that infringes the intellectual property or other rights of any third party
• Upload content depicting nudity, minors, or non-consensual imagery of any kind
• Create synthetic media that falsely depicts or impersonates real individuals without their informed, documented consent
• Reverse-engineer, decompile, or attempt to extract Drape's AI models, proprietary weights, or system prompts
• Abuse the credit system through automation, scraping, or unauthorized API access beyond what is documented in our public API
• Resell, sublicense, or commercialize access to the Service as a standalone product without our prior written permission
• Use the Service in violation of any applicable law or regulation, including export controls or sanctions programs
• Interfere with the integrity, security, or performance of the Service or its underlying infrastructure

We reserve the right to suspend or terminate accounts we determine are in violation of these prohibitions, without refund.

You may terminate your account at any time through your account settings or by contacting us at support@drapenow.com. Termination stops future charges but does not entitle you to a refund for unused credits or the remainder of a subscription period.

Drape may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, pose a risk to other users or the Service, or for any legitimate business reason. Upon termination, your right to access the Service ceases immediately.

We will make reasonable efforts to allow you to export your generated video files before account deletion. Project data may be permanently deleted 30 days after account termination.

Disclaimer of warranties. The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that generated content will meet your expectations.

Limitation of liability. To the maximum extent permitted by applicable law, Drape's total liability to you for any claim arising from or related to the Service is limited to the greater of (a) the total amount you paid to Drape in the 12 months immediately preceding the claim, or (b) USD $100. In no event will Drape be liable for indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or business opportunities — even if advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions our liability is limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Drape and its officers, directors, employees, and agents from any and all claims, damages, losses, liabilities, and costs (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights, including intellectual property rights. Drape reserves the right to assume exclusive control of the defense of any claim for which we are entitled to indemnification, at your expense.

European Economic Area & UK (GDPR). If you are located in the EEA, United Kingdom, or Switzerland, you have additional rights under the General Data Protection Regulation (GDPR) and equivalent laws, including rights to access, correct, delete, and port your personal data, and to object to certain processing. Our legal bases for processing include contract performance, legitimate interests, and — where required — your explicit consent. California (CCPA / CPRA). California residents have rights under the California Consumer Privacy Act, including the right to know what personal information we collect, the right to request deletion, and the right to opt out of the sale or sharing of personal information. We do not sell or share your personal information for cross-context behavioral advertising. See our Privacy Policy for instructions on exercising these rights.

General. The Service is operated from the United States. If you access the Service from outside the US, you acknowledge that your information may be transferred to and processed in the US, which may have different data protection standards than your country of residence.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from or related to these Terms or the Service that cannot be resolved informally will be subject to the exclusive jurisdiction of the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

Informal resolution. Before filing any claim, you agree to first attempt informal resolution by contacting us at legal@drapenow.com. We will attempt to resolve the dispute within 30 days of receiving your notice.

Class action waiver. To the extent permitted by applicable law, you waive any right to bring claims as a plaintiff or class member in any class action or representative proceeding. You may only bring claims in your individual capacity.

If you are an EU consumer, you may also contact your local consumer protection authority or use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

We may modify these Terms at any time. For material changes, we will provide at least 14 days' advance notice via email or a prominent notice within the Service. Your continued use of the Service after the effective date of any revision constitutes acceptance of the updated Terms. If you disagree with a change, you must stop using the Service and may cancel your subscription before the effective date to receive a pro-rated refund for the unused portion of your current billing period.
